Spyker to take Aguri to court

The Spyker F1 team will have to go to court for arbitration over the whether the Super Aguri car is legal within the current definition of the rules, Spyker boss Colin Kolles told reporters at the Albert Park circuit. 

Super Aguri has surprised many with its pace so far this weekend and Kolles believes that is because it is effectively last year's race-winning Honda car and therefore the team is in breach of rules that say teams must design their own cars. This rule is set to change next year and will open the door for the likes of Prodrive to buy their cars from another team.

The Spyker team asked for clarification from stewards at the Australian Grand Prix but they dodged the bullet saying it is not something they can rule on because the dispute is over an interpretation of F1's secret Concorde Agreement. The Stewards added that because of that, it was not something the FIA could decide on. Kolles now argues that is against the fact that Super Aguri said its cars had the approval of the FIA.

Bernie Ecclestone had proposed that Super Aguri and Toro Rosso - who are also not clear of suspicion over whether their current car is the same as last year's Red Bull, would not earn constructors' championship points, by way of a comrpomise. However Toro Rosso and Super Aguri rejected that plan, something Kolles and Spyker would have been happy with.

The case is now set to be heard by the courts in Switzerland. The WilliamsF1 teamis also reportedly concerned about the legality of Super Aguri and Toro Rosso cars, but keeping a low profile until it becomes clear what is likely to happen.
